Terms and Conditions
Event London Limited (trading as Event UK) has made every effort to word these terms and conditions in plain English. If you do not understand any part of these terms, please call us for clarification or seek legal advice before agreeing to them. By registering and using the website you signify your agreement to be bound by these terms and conditions.
When you apply for registration to the Event UK database, we ask you for some personal and professional information which, once approved, will be visible to anyone with internet access looking at your profile on the website. By allowing you to post information on the website, you hereby grant us permission to use, copy, distribute, publish and transmit such information.
We follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access in accordance with the UK data protection legislation.
Please ensure that the details you provide us with are correct and complete and update your profile immediately of any changes to the information that you provided when registering. You can access and update the information you provided us with in the profile area of the website.
If you register a profile, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
By placing information on the website you agree to abide by these terms and conditions, and you shall not post: (i) any information which is objectionable including, without limitation, information which is defamatory, obscene, threatening or in breach of any applicable laws, rules or regulations; (ii) any information or software which contains a virus, or is otherwise harmful to the integrity of the website or other users.
We do not guarantee the validity of the information you post on the website and therefore do not accept responsibility for, or make any warranties in connection with such information. You bear all risks from posting information or results of uploading material to the website and from using any information. We, however, reserve the right to monitor and remove any information from the website without warning.
Bookings
This booking is negotiated by Event UK (the ‘agent’) between the ‘client’ and the ‘artist’. In this respect, Event UK acts as an entertainment agency in issuing this booking and cannot be held responsible for non-fulfillment of bookings or non-payment of fees.
Any booking whether confirmed verbally, electronically or in writing by Event UK will be subject to a legally binding contract carrying the following non-negotiable terms and conditions:
The ‘artist’ agrees to provide a performance that is to the best of their ability. The artist will make every effort to ensure their performance is outstanding, adhere to the client’s wishes within all reasonableness, be polite and courteous with the client, their guests and all venue staff and contractors.
The ‘artist’ agrees to provide all equipment required to undertake this performance, unless the equipment has been contractually agreed to be provided by the ‘client’ or a third party. It is the ‘artists’ responsibility to ensure the good working order & safety of their own equipment, and to obtain all necessary insurances & certification.
The adjustment of the volume and sound level of any equipment shall be as the ‘client’ reasonably requires.
The 'artist' accepts full responsibility for maintaining their own Public Liability Insurance, their own equipment insurance, vehicle insurance and for carrying out the P.A.T. testing of their equipment.
The ‘artist’ shall be suitably and tidily dressed during their performance except with the consent of the client or where the wearing of other attire is deemed to be a necessary part of their act.
The ‘artist’ will not breach any music copyright laws.
The ‘artist’ will not under any circumstances partake of any illegal drug use on the day of the event, or whilst at the event 'venue', or whilst in the presence of the client, their guests, venue staff or other associated suppliers or artists. The ‘artist’ shall not display any other conduct deemed anti-social, illegal, nor reflecting badly upon themselves, Event UK, or the ‘client’. The artist will not smoke in restricted areas or park their vehicles in restricted areas at the performance venue.
The ‘artist’ agrees that where their performance is deemed unsatisfactory for whatever reason by the ‘client’, the ‘client’ reserves the right to reduce the agreed fee.
The ‘artist’ at the time of agreeing to these terms and conditions shall not be under any contract to a third party that might preclude him/her from fulfilling the engagement.
The ‘artist’ agrees that their fee is inclusive of all expenses.
The ‘artist’ is not employed by Event UK and is solely responsible for their individual tax liabilities, National Insurance contributions and, if applicable, VAT.
Changes to the contract must be arranged and agreed by Event UK in advance of the performance.
Cancellation of a booking by the 'client' can be given to Event UK before the agreed performance has commenced. Event UK agrees to inform the ‘artist’ of the cancellation immediately.
In the unlikely event that the ‘artist’ cancels the booking, the ‘artist’ agrees to inform Event UK immediately. Event UK agrees to inform the ‘client’ of the cancellation and make all reasonable attempts to find a suitable replacement artist of similar standard and style.
Should the ‘artist’ cancel a booking under circumstances not covered by 'force majeure', the ‘client’ may pursue unlimited damages from the ‘artist’ as they see fit.
Where possible, changes to the contract schedule which are unavoidable on the day of the booking should first be discussed & agreed with Event UK. Should this not be possible, changes are to be agreed between the ‘client’ and the ‘artist’ prior to performance and will be subject to these terms and conditions.
If changes negotiated between the ‘client’ and the ‘artist’ on the day of the event are agreed to incur additional costs to the ‘client’, the ‘artist’ accepts full responsibility for advising any change in fee and agrees that these fees will be subject to Event UK’s standard rate of commission.
Payment fees to artists
The agreed booking fee is due within 28 working days of performance, subject to an acceptable invoice. Fees are payable via BACS transfer.
Event undertakes to act as an agent processing payments between the ‘artist’ and the ‘client’. By signing this document the ‘artist’ agrees that they will not hold Event UK liable for amounts that have not been paid to Event UK by the ‘client’ .
General
Whilst Event UK cannot be held responsible for the actions or failures of either the 'client' or 'artist' we will make every effort to settle disputes. Event UK will act as mediator between 'client' and 'artist' in order to come to an amicable agreement. If Event UK cannot settle the dispute to the mutual satisfaction of both 'client' and 'artist', both parties must settle the matter directly via their own legal representatives.
Force Majeure
In cases of ‘force majeure’ (which shall be known as war, fire, death, illness or other capacity certified by a properly qualified medical practitioner, epidemic, accident, civil commotion, national calamity, order of Government, act of God), which are not attributable to any act or failure to take preventive action by the ‘artist’ or ‘client’, then the ‘artist’ or ‘client’ may cancel this booking without penalty.
Copyright and Database Rights
All content and software included on the website, is the property of Event UK, its affiliates or its content suppliers and is protected by United Kingdom and international copyright and database right laws.
You may not systematically extract and/or re-utilise parts of the contents of the website without Event UK’s express written consent. You also may not create and/or publish your own database that features substantial parts of this website without Event UK’s express written consent.
Jurisdiction
Disputes arising from or in connection with this Agreement shall be subject to the non-exclusive jurisdiction of the English Court.
